Terms of Service

Effective date: 28 October 2026

Privacy Terms Refunds Data deletion

These Terms of Service ("Terms") are an agreement between you and Qubelex Private Limited ("Med99", "we", "us", "our") for the use of the Med99 website (med99.in), Android app and web app (web.med99.in) (together, the "Service"). By creating an account, starting a trial, paying for a plan or otherwise using the Service, you agree to these Terms, our Privacy Policy and our Refund and Cancellation Policy. If you are using Med99 for a business, you confirm you are authorised to accept these Terms for that business.

1. Who can use Med99

You must be at least 18 years old and able to enter a binding contract under Indian law. Med99 is meant for pharmacies, medical stores and similar businesses. You are responsible for holding and keeping valid every licence and registration your business needs, including drug licences and GST registration.

2. Your account, MID and PID

Each business account has a Merchant ID ("MID"). A MID can have one or more pharmacies, each with its own Pharmacy ID ("PID"). You are responsible for:

  • giving accurate information when you sign up and keeping it up to date;
  • keeping your login details secret and all activity under your MID, including by staff you give access to;
  • removing access for staff who leave; and
  • telling us at support@med99.in straight away if you think your account has been misused.

3. Plans, trials and payments

  • Med99 offers a Free plan and paid plans (such as Silver and Gold). Features, limits and prices are as shown in the app or at checkout at the time you buy, and may change for future billing periods with notice.
  • A free trial (for example, 3 days of Gold) lets you try paid features before paying. When a trial ends you move to the Free plan unless you buy a paid plan. We may limit trials to one per business.
  • Paid plans are bought through our website or web app using a third-party payment gateway. Prices are in Indian Rupees, and applicable taxes, including GST, are shown at checkout.
  • A paid plan is active for the period you pay for. If you turn on autopay, the plan renews and is charged automatically each billing period until you cancel, whether or not you use the app. You will be notified at least 3 days before each automatic debit, and it is your responsibility to cancel autopay before the debit date if you no longer want the plan. Only the most recent autopay payment can be refunded, as set out in our Refund and Cancellation Policy.
  • A GST tax invoice is issued for every payment, including each autopay renewal, and the tax is paid to the government when you are charged.
  • Payments are non-refundable except as set out in our Refund and Cancellation Policy.

4. Your responsibilities as a pharmacy

Med99 is a software tool for billing, stock and record-keeping. You stay fully responsible for how your business is run, including:

  • following the Drugs and Cosmetics Act, 1940 and its rules, including the sale of prescription-only medicines, Schedule H, H1 and X requirements, and any registers you must keep;
  • following GST and other tax laws, including the correct HSN codes, tax rates, invoice contents, returns and filing;
  • checking that every bill, invoice, price, batch, expiry date, stock count and report is correct before you rely on it or give it to anyone;
  • having the right to record the personal data of your customers, patients, staff and suppliers in Med99, and handling it lawfully; and
  • keeping your own exports or backups of any records you are legally required to keep.

5. No medical, legal or tax advice

Med99 does not give medical, pharmaceutical, legal, tax or accounting advice. Medicine names, compositions, tax rates, alerts and reports shown in the Service are for convenience only and may be incomplete or out of date. Med99 does not check prescriptions, drug interactions or whether a sale is allowed. Always use your professional judgement and check with a qualified professional where needed.

6. Your data

You own the data you enter into Med99 ("Store Data"). You give us permission to host, copy, process and display Store Data only as needed to provide, secure and support the Service, and as described in our Privacy Policy. You can export your data from the app while your account is active. You are responsible for exporting anything you need before you cancel, downgrade or ask for deletion.

7. Data deletion — permanent and cannot be undone

You can ask us to delete specific data, all data of one pharmacy (PID), or your whole account and every pharmacy under it (MID) using our data deletion request form. By submitting a deletion request, you understand and agree that:

  • Deleted data cannot be recovered. Once deletion is done, neither you nor Med99 can restore it, including from backups, and Med99 support cannot get it back for any reason.
  • Deleting a MID deletes every pharmacy (PID), user, bill, invoice, stock record, customer, supplier and report under it, and closes the account.
  • Deleting a PID deletes all data for that pharmacy. Other pharmacies under the same MID are not affected.
  • You are solely responsible for first exporting and keeping any records you must keep by law, including GST, tax, accounting and drug-sale records, for the period the law requires. Med99 is not responsible for any loss, penalty or claim caused by deleting data you asked us to delete.
  • Deleting data or an account does not entitle you to a refund. Any remaining paid period on a deleted MID or PID is forfeited.
  • We may contact you using the details in your account to confirm the request before acting on it, and we may refuse or delay a request we cannot verify, or one that conflicts with a legal obligation or an ongoing dispute or investigation.
  • We may keep limited records as required or permitted by law, as described in our Privacy Policy, including a record of the deletion request.

8. Acceptable use

You must not:

  • use the Service for anything illegal, including the sale of medicines without the required licence or prescription, or to create false invoices or records;
  • upload data you have no right to use, or anything harmful such as malware;
  • try to access another user's account or data, or get around security, plan limits or payment;
  • copy, resell, reverse engineer or build a competing product from the Service, except as the law allows; or
  • overload, disrupt or scrape the Service, or use automated tools against it without our written permission.

9. Availability and changes

We work to keep Med99 available and reliable, but we do not promise it will always be available, uninterrupted or error-free. Maintenance, updates, internet and device problems, and third-party services can cause downtime or data sync delays. We may change, add or remove features. If we stop offering a paid feature you have already paid for, we will give you reasonable notice.

10. Third-party services

The Service relies on third parties such as Google Play, cloud hosting providers and payment gateways. Their own terms apply to your use of them, and we are not responsible for their acts or failures.

11. Intellectual property

Med99, its software, design, logos and content belong to us or our licensors. We give you a limited, non-exclusive, non-transferable right to use the Service for your own business while these Terms are in effect. Feedback you send us may be used by us freely and without obligation to you.

12. Suspension and termination

You can stop using Med99 at any time. We may suspend or close your account, with notice where reasonable, if you break these Terms, fail to pay, misuse the Service, create risk or legal exposure for us or others, or if required by law. If we close your account without cause, we will give you a reasonable opportunity to export your data. Sections that by their nature should continue (including 4–7 and 13–18) survive termination.

13. Disclaimer

To the extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, merchantability and non-infringement.

14. Limitation of liability

To the extent permitted by law:

  • Med99 is not liable for any indirect, incidental, special or consequential loss, or for loss of profits, revenue, business, goodwill or data, or for fines, penalties or tax demands, however caused; and
  • Med99's total liability for all claims relating to the Service is limited to the amount you paid us for the Service in the 3 months before the event giving rise to the claim.

Nothing in these Terms limits liability that cannot be limited by law.

15. Indemnity

You agree to compensate and protect Med99, its owners, staff and partners from any claim, loss, penalty or expense (including reasonable legal fees) arising from your business, your Store Data, your breach of these Terms, or your breach of any law or of anyone else's rights.

16. Changes to these Terms

We may update these Terms from time to time. We will post the new version here with a new effective date and, for significant changes, tell you in the app or by email. Continuing to use the Service after a change means you accept the updated Terms.

17. General

If any part of these Terms is found unenforceable, the rest stays in effect. Not enforcing a right does not waive it. You may not transfer these Terms without our consent; we may transfer them as part of a merger, acquisition or sale of assets. These Terms, together with the policies they refer to, are the whole agreement between you and Med99 about the Service.

18. Governing law and disputes

These Terms are governed by the laws of India. Please contact us first so we can try to resolve any dispute informally. Subject to that, the courts at Hyderabad, Telangana have exclusive jurisdiction.
